Submitting a Copyright Notice — DMCA §512(c)(3)

Your notice should include:

Removal and Notification
Upon receipt of a valid DMCA notification, HeyDownloads may expeditiously remove or disable access to the material identified in the notice.
Where applicable, we will notify the seller, contributor, or user responsible for the affected material and provide information regarding the counter-notification procedure.
Counter-Notification — DMCA §512(g)
If material you submitted has been removed or disabled as a result of a DMCA notice and you believe that the removal resulted from mistake or misidentification, you may submit a written counter-notification.
The counter-notification should include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location at which the material appeared before it was removed or disabled.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, for any judicial district in which HeyDownloads may be found, and stating that you will accept service of process from the person who submitted the original notification or that person’s agent.

Following receipt of a valid counter-notification, HeyDownloads may restore the affected material not less than 10 and not more than 14 business days after receipt of the counter-notification unless the party who submitted the original copyright notice informs us that it has filed a court action seeking to restrain the allegedly infringing activity.
Repeat Infringer Policy
HeyDownloads does not permit repeated infringement of intellectual-property rights through its platform.
In appropriate circumstances, HeyDownloads may suspend or terminate the accounts or marketplace access of sellers, contributors, or other users who repeatedly infringe, or are reasonably determined to have repeatedly infringed, the intellectual-property rights of others.
HeyDownloads may also remove or disable access to content where we obtain actual knowledge of infringement or become aware of facts or circumstances indicating infringing activity.
Good-Faith Notices
Please submit copyright notices and counter-notifications in good faith.
Knowingly making material misrepresentations concerning whether material or activity is infringing, or whether material was removed or disabled by mistake or misidentification, may result in liability under applicable law.
